These terms cover your use of EmoteFactory (the "service"), operated by [OPERATOR] ("we", "us"). By creating an account or buying credits you agree to them.
EmoteFactory is an independent tool. We are not affiliated with Twitch Interactive, Inc., Discord Inc., Kick, YouTube, 7TV or BTTV, and nothing here grants rights to those platforms.
Your account
You need an account to buy credits and download sets. You are responsible for keeping access to it secure, and for the accuracy of the email address you register with — that is how we identify you for support and refunds.
You must be old enough to enter a contract in your jurisdiction, and old enough to comply with the minimum age on any platform you upload to.
Credits
- Credits are a prepaid unit used to buy generation actions. They are not money, do not earn interest, and are not transferable between accounts.
- Credits bought from a one-time pack never expire.
- Credits granted by a subscription roll over for one month and then lapse.
- Failed generations do not consume credits. Each emote includes three regenerations at no cost.
- Subscription credits are spent before purchased credits, because purchased credits do not expire.
What you own
You own the images you generate and can use them on your own channel, on merchandise and in promotional material for your channel.
On Studio and Agency plans you also get a commercial licence covering client work. On Starter, Pro and Channel Kit the licence is for your own channel use.
We do not claim ownership of your prompts or outputs. We do store them to operate the service and to show you your own library.
What you are responsible for
- The content of your prompts and the images you upload. Do not generate or upload material that infringes someone else's rights.
- Whether an emote complies with the rules of the platform you upload it to. Meeting a platform's content rules and copyright policy is your responsibility, not ours.
- Your own compliance with Twitch, Discord, Kick or YouTube terms when you use the outputs there.
What we do not promise
Generated images are probabilistic. We score each emote for readability at 28 pixels and measure consistency across a set, but we cannot guarantee that any given generation will match your intent, or that a platform will approve an upload.
We do not guarantee uninterrupted availability. We may change, suspend or discontinue features.
Acceptable use
- Do not attempt to access other users' accounts or data.
- Do not use the service to generate content that is unlawful, hateful, sexual involving minors, or that infringes third-party intellectual property.
- Do not resell credits or resell raw generation capacity. Building emotes for clients is allowed on the appropriate plan; reselling the service itself is not.
Ending the agreement
You can stop using the service at any time. We may suspend or close an account that breaks these terms, and will tell you why where we lawfully can.
If we close your account for a reason that is not your breach, we will refund unused purchased credits.
Liability
To the extent the law allows, our total liability for any claim is limited to the amount you paid us in the twelve months before the claim.
We are not liable for indirect or consequential losses, including lost revenue, lost subscribers, or a platform rejecting or removing your emote.
Changes
We may update these terms. Material changes will be announced in the product or by email before they take effect. Continuing to use the service after that means you accept the updated terms.
